Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TestPilot AI (“Service”), operated by NuralStack (“we”, “us”, or “our”), accessible at www.nuralstack-testpilot.com. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

TestPilot AI is an AI-powered software testing platform that allows organisations to upload requirements, target a web application URL, and automatically generate and execute test cases using AI and browser automation (Playwright). The Service produces test reports, screenshots, and analytical insights.

2. Eligibility & Account Registration

  • You must be at least 18 years old and have legal authority to enter into these Terms on behalf of yourself or your organisation.
  • Accounts are created by invitation only. Organisation administrators invite team members via email. You are responsible for maintaining the confidentiality of your credentials.
  • You agree to provide accurate, current, and complete registration information and to keep it up to date.
  • You must not share your account credentials. Notify us immediately at support@nuralstack-testpilot.com if you suspect unauthorised access.

3. Acceptable Use

You agree to use the Service only to test web applications for which you have lawful authority. You must not:

  • Test applications or URLs without the owner’s explicit consent.
  • Use the Service to conduct denial-of-service attacks, scraping campaigns, or any activity that harms third-party systems.
  • Attempt to circumvent rate limits, abuse trial credits, or interfere with the Service’s infrastructure.
  • Upload content that is unlawful, harmful, threatening, defamatory, or infringing of third-party intellectual property rights.
  • Resell, sublicense, or otherwise exploit the Service without prior written consent.
  • Reverse-engineer, decompile, or disassemble any portion of the Service.

Violations may result in immediate account suspension or termination at our sole discretion. See our Acceptable Use Policy for full details.

4. Plans, Credits & Billing

  • Credits: The Service operates on a credit system. Each test run consumes one (1) credit. Credits are allocated per your subscription plan and reset monthly.
  • Plans: Subscription plans (Starter, Growth, Business, Enterprise) are described on our pricing page. Enterprise pricing is negotiated directly.
  • Payment: Subscription fees are billed in advance, monthly or annually. All fees are non-refundable except as required by applicable law or as stated in a separate order form.
  • Upgrades & Downgrades: Plan changes take effect at the start of the next billing period.
  • Taxes: You are responsible for all applicable taxes, duties, and levies.
  • Free Trial / Free Tier: Free-tier credits are limited and may be withdrawn at any time.

5. Data & Storage

  • Your Data: Requirements text, test plans, screenshots, and reports you generate are “Customer Data”. You retain all ownership of Customer Data.
  • Storage: Customer Data is stored in the cloud storage provider you connect (Google Drive, OneDrive, or our default Amazon S3 bucket). You are responsible for your storage provider configuration and access controls.
  • Data Processing: We process Customer Data solely to provide and improve the Service. We use Anthropic’s Claude API to generate test cases and analyses; by using the Service you acknowledge that anonymised requirement snippets may be sent to Anthropic for inference. We do not use your data to train AI models.
  • Retention: We retain account and usage metadata for up to 12 months after account closure, after which it is deleted.

6. AI-Generated Content

The Service uses large language models (Claude) to generate test cases, requirements analyses, and reports. You acknowledge that:

  • AI output may be inaccurate, incomplete, or unsuitable for your specific needs. You are responsible for reviewing, validating, and approving all AI-generated test plans before execution.
  • We do not warrant that AI-generated tests will cover all defects, security vulnerabilities, or functional issues in your application.
  • You own any AI-generated content produced for your account.

7. Intellectual Property

  • The Service, including its UI, branding, documentation, and underlying technology, is owned by NuralStack and protected by intellectual property laws.
  • We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription term, solely for your internal business purposes.
  • We may use your organisation’s name or logo as a customer reference unless you opt out in writing.

8. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Security

We implement industry-standard security measures including encryption in transit (TLS), encrypted storage, JWT-based authentication with short-lived tokens, and rate limiting. However, no system is perfectly secure. You are responsible for the security of your account credentials and for ensuring that the URLs you submit for testing belong to or are authorised by you.

10. Availability & SLA

We strive for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated where practical. We are not liable for downtime caused by third-party services (AWS, Anthropic, Google Drive, etc.) or events outside our reasonable control.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NURALSTACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless NuralStack, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your Customer Data; or (c) your violation of any third-party rights.

14. Termination

  • You may cancel your subscription at any time by contacting support@nuralstack-testpilot.com. Access continues until the end of the current billing period.
  • We may suspend or terminate your account immediately for material breach of these Terms, non-payment, or as required by law.
  • Upon termination, your right to use the Service ceases. We will make Customer Data available for export for 30 days, after which it may be deleted.

15. Changes to Terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be resolved through binding arbitration or the competent courts of Tamil Nadu, India, at our election.

17. Miscellaneous

  • Entire Agreement: These Terms, along with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and NuralStack regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Failure to enforce any provision does not constitute a waiver of our rights.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
